1. About this Privacy Policy
Cherry Media Services B.V. (“Cherry Media”, “we”, “us”) respects your privacy and handles personal data with care. This Privacy Policy explains what personal data we collect, why we use it, with whom it may be shared and how long it may be retained.
Cherry Media is established in Curaçao and processes personal data in accordance with applicable Curaçao legislation, including the Landsverordening bescherming persoonsgegevens.
The Curaçao LBP regulates the collection, storage, use, disclosure and deletion of personal data and provides rights to individuals whose data is processed
2. Personal Data We Collect
When you contact Cherry Media through our website, email, telephone or in connection with an assignment, we may process information such as your name, company name, email address, telephone number, business or billing address, billing information, correspondence and information you voluntarily provide in a message or during the course of an assignment.
Our website contact form asks for your name, company name, email address, telephone number and message.
Please do not provide sensitive personal information unless it is genuinely necessary for your request or assignment.
3. Why We Use Personal Data
We use personal data where reasonably necessary to communicate with prospective and existing clients, respond to enquiries, prepare quotations, enter into and perform agreements, manage projects, provide our services, issue and administer invoices, maintain business records, meet legal and tax obligations, resolve questions or disputes and operate and protect our business.
Cherry Media does not maintain a consumer newsletter or email marketing database and does not sell personal data to third parties.
4. Contact Form
Information submitted through our contact form is used to respond to your enquiry and, where relevant, to prepare or perform an assignment.
Submitting the contact form does not subscribe you to a newsletter or marketing mailing list.
If an enquiry does not lead to an assignment, we do not retain the information longer than reasonably necessary for the purpose for which it was received, unless there is a legitimate business or legal reason to retain it.
5. Client Administration
When you become a Client, we may retain relevant contact, contractual, project, correspondence and financial information as part of our business administration.
This information may be stored in systems including Odoo, email, Google Drive and secured computers or other systems used by Cherry Media for its business operations.
Access is limited to what is reasonably necessary for Cherry Media's operations and services.
6. Service Providers
Cherry Media uses third-party service providers where necessary to operate its business and provide services.
These may include Odoo, Google, email services, hosting providers, domain and website providers and other technical or administrative service providers used in connection with a specific assignment.
Personal data is shared only to the extent reasonably necessary for the relevant service or business purpose.
Cherry Media does not provide personal data to unrelated third parties for their own advertising purposes.
Some service providers may process or store information outside Curaçao. Where this occurs, Cherry Media will take reasonable steps to handle such transfers in accordance with applicable data-protection requirements.
7. Retention
Cherry Media retains personal data only for as long as reasonably necessary for the purpose for which it was collected or for as long as required by applicable law.
Curaçao tax law requires businesses to retain their administration and the related records for ten years. The Curaçao Tax Authority expressly states that entrepreneurs must retain their administration for ten years, and Article 43 of the Algemene landsverordening Landsbelastingen contains this retention obligation.
Personal data forming part of our financial, contractual or tax administration may therefore be retained for this statutory period.
Other information, such as an enquiry that does not result in an assignment, is not automatically retained for ten years and may be deleted once it is no longer reasonably required.
8. Security
Cherry Media takes reasonable organizational and technical measures to protect personal data against loss, unauthorized access, misuse, alteration or disclosure.
No digital system can be guaranteed to be completely secure. We therefore periodically review the systems and services used for our business operations and take reasonable measures appropriate to the nature of the information we process.
9. Your Rights
Subject to applicable Curaçao law, you may contact Cherry Media to ask what personal data we hold about you, request correction of inaccurate information, or request deletion or restriction of information where there is no overriding legal or legitimate reason for us to retain or process it.
Certain information cannot be deleted on request where Cherry Media is legally required to retain it, for example as part of its statutory financial administration.
We may ask for sufficient information to verify your identity before acting on a privacy request.
10. Cookies
Our website uses cookies and similar technical functionality. More information is available in our Cookie Policy.
Cherry Media currently does not use Google Analytics, Google Tag Manager, Meta Pixel, Google Ads remarketing or comparable advertising tracking on this website.
11. Changes to this Privacy Policy
We may update this Privacy Policy when our website, services, systems or legal obligations change.
The most recent version will be published on our website with its latest revision date.
